Under the Fair Housing Act (42 U.S.C. § 3604) and NAR Code of Ethics Article 10, agents who characterize neighborhood safety risk steering liability — even when the buyer is asking directly. Agent describes a neighborhood as safe or unsafe. Any characterization tied to a protected-class demographic — even unintentionally — creates Fair Housing Act exposure under 42 U.S.C. § 3604(a).

Fair Housing Act — 42 U.S.C. § 3604: Prohibits steering based on race, color, national origin, religion, sex, familial status, or disability. This includes selectively withholding or characterizing neighborhood information in a way that influences a buyer's decision on those bases. NAR Code of Ethics Article 10 extends this obligation to all REALTORS regardless of state law. The practical effect: agents cannot answer the safety question without risk.
